  • No advisory services: No advisory services are provided. Instead, proposed solutions are presented that relate to a selection of credit agreements/products available on the market.

  • Alternative dispute resolution: In addition, the state-recognised Schlichtung für Verbrauchergeschäfte (Austrian consumer arbitration body) is available to you (Flachgasse 30/2. OG, 1150 Vienna, office@verbraucherschlichtung.at, https://www.verbraucherschlichtung.at). The procedure is free of charge for consumers; participation is voluntary for both sides. Recourse to the ordinary courts remains open to you regardless.
  • Remuneration: For successful credit intermediation, the credit intermediary receives, where a loan is concluded, remuneration of 3% of the approved gross loan amount in total, which is borne by the borrower. Depending on the lending bank, this remuneration consists of a commission of the lender co-financed through the loan (depending on the bank e.g.: as an internal commission, as a credit intermediary commission or as a share of the bank processing fee) and, where the lender's commission does not reach this 3%, of a success fee payable by you directly. The success fee payable by you directly amounts to at most 1.5% of the approved gross loan amount. If the entire commission of 3% is co-financed through the loan, your direct payment does not apply. The lender's commission is offset against the total remuneration. The type and amount of the lender's commission are not yet fixed before the intermediation. The amount is stated in the ESIS information sheet (European Standardised Information Sheet). Consumers may request information on the respective commission levels of the credit agreements offered. Any success fee falls due after signing the loan agreement, within 14 days of receiving the commission note. Under § 9 of the Code of Conduct Regulation (BGBl. II No. 86/2016) the intermediary commission may not exceed 5% of the gross loan amount.
  • Information to be provided by the person seeking credit: For a loan to be granted, the person seeking credit must provide information and evidence verifiable by third parties; these details must be correct and sufficiently complete for a proper creditworthiness assessment.

Remuneration of the brokerage

This is how the brokerage is remunerated:

  • Total remuneration: For a successful brokerage (= conclusion of the loan) the intermediary receives remuneration of 3% of the approved gross loan amount in total.
  • Composition: Depending on the lending bank, this remuneration consists of a commission from the lender that is co-financed through the loan (e.g. an internal commission, a credit intermediary commission paid by the bank, or a share of the bank processing fee) and — where that commission does not reach the 3% — of a success fee payable by you directly. The lender's commission is offset against the total remuneration.
  • Your share: The success fee payable by you directly amounts to at most 1.5% of the approved gross loan amount. If the entire commission of 3% is co-financed through the loan, your direct payment does not apply at all. It is due after signing the loan agreement, within 14 days of receiving the commission note.
  • Offsetting: If FA – FinanzAktiv e.U. receives a commission from the lender, it is offset in full against the total remuneration of 3%; your share is only the remainder up to 3%, but at most 1.5%. Example 1: with a gross loan amount of 300,000 euro and a lender's commission of 2.5% (7,500 euro) your share is 0.5% (1,500 euro). Example 2: if the lender bears only 1% (3,000 euro), your share is 1.5% (4,500 euro). If the lender bears 3% or more, you pay nothing.
  • Reference amount: the “gross loan amount” is the loan amount approved by the bank under the loan agreement (nominal amount), excluding any co-financed interest.
  • Value added tax: The success fee is exempt from value added tax (§ 6 Abs. 1 Z 8 lit. a UStG, Austrian VAT Act); no VAT is added.
  • ESIS disclosure: The type and amount of the lender's commission are not yet fixed before the brokerage; the amount is stated in the ESIS information sheet (European Standardised Information Sheet). You may request information on the respective commission levels of the loan agreements offered.
  • Transparency: Only the amounts stated in the loan agreement or the commission note apply.
  • Cap: The total intermediary commission does not exceed 5% of the gross loan amount (§ 9 Code of Conduct Regulation, BGBl. II No. 86/2016).

Data protection & sharing with credit institutions

To assess your financing, we process and transmit personal data:

  • Purpose: preparing and brokering your home financing (Art. 6(1)(b) GDPR).
  • Sharing with credit institutions: your details and documents are transmitted to the banks/building societies eligible for your enquiry; for this you release them from banking secrecy towards you (§ 38(2)(5) Austrian Banking Act).
  • Creditworthiness check: during the check, the banks may obtain information from credit bureaus (e.g. KSV 1870, CRIF) and report data to the small-credit register/warning list.
  • EU processing: your data stays in Europe and is stored encrypted; identity data is specially protected.
  • Your rights: access, rectification, erasure, objection; a withdrawal takes effect for the future.

Distance marketing information

Because you are arranging your financing entirely digitally, without simultaneous physical presence, the brokerage contract with FA – FinanzAktiv e.U. is a distance contract for a financial service:

  • Legal basis: for contracts concluded up to 30 September 2026 the Fern-Finanzdienstleistungs-Gesetz (FernFinG, Austrian Distance Marketing of Financial Services Act); for contracts concluded from 1 October 2026 §§ 18a to 18d of the Fern- und Auswärtsgeschäfte-Gesetz (FAGG, Austrian Distance and Off-Premises Contracts Act) as amended by the Verbraucherrechts-Änderungsgesetz 2026 (VerbRÄG 2026, BGBl. I Nr. 59/2026).

  • Key features: the subject matter is the brokerage of home financing — not an advisory service. The credit decision is made solely by the bank.
  • Total price: composition, caps and the offsetting of the lender's commission are set out in the remuneration information; the success fee is exempt from value added tax; the final amount is stated in the ESIS information sheet. Our remuneration is not personalised on the basis of automated decision-making.
  • Right of withdrawal: you may withdraw from the brokerage contract within 14 calendar days without giving reasons. Details on when the period starts, how to exercise the right and its consequences are set out in the separate withdrawal information; you can withdraw at any time via the “Withdraw from contract” button, by email to office@kreditdirekt.at or using the model withdrawal form.
  • Human intervention: the AI assistant is an online tool. At any time — before the contract is concluded and, in justified cases, afterwards — you can request that a human intervene: via “Request a call back”, by telephone on +43 650 9033600, by email to office@kreditdirekt.at or directly in the chat interface. Your personal contact reviews every case personally in any event.

  • How long bank offers are binding: the lender is bound by its offer for at least 7 days (§ 12 HIKrG).
  • Communication: correspondence takes place in German or English.

Withdrawal information for the brokerage contract

This information concerns the brokerage contract you conclude with FA – FinanzAktiv e.U. — not the later credit agreement with the bank. Separate rights apply to that agreement (see below).

  • Right of withdrawal: you may withdraw the declaration aimed at concluding the brokerage contract within 14 calendar days without giving reasons (§ 8 FernFinG; for contracts concluded from 1 October 2026 § 18b FAGG as amended by VerbRÄG 2026, BGBl. I Nr. 59/2026).
  • Start of the period: the period starts on the day the contract is concluded; if you receive the contract terms and the statutory information later, it starts when you receive them.
  • How to withdraw: most simply via the “Withdraw from contract” button available at the bottom of every page (kreditdirekt.at/en/widerruf). If you use this online function, we send you by email, without delay, a confirmation of receipt stating the content of your declaration of withdrawal as well as the date and time it was received. An unambiguous declaration in text form (e.g. by email to office@kreditdirekt.at) to FA – FinanzAktiv e.U., Getreidegasse 3, 9020 Klagenfurt am Wörthersee, telephone +43 650 9033600, is equally sufficient; you may use the model withdrawal form for this (kreditdirekt.at/en/widerruf/formular), but you do not have to. Timely dispatch suffices.
  • Starting the brokerage early: within the 14 days the brokerage work only begins if you expressly request it; you make that request in a separate step and it is recorded with the time and the text version. That request is not a general waiver of your right of withdrawal. Your right of withdrawal may, however, lapse once the brokerage contract has been fully performed by both parties at your express request (§ 10 Z 3 FernFinG; for contracts concluded from 1 October 2026 § 18b Abs. 5 Z 3 FAGG).
  • Consequences: in the event of withdrawal, services received are reversed; data releases already granted do not take effect retroactively. If you withdraw before a credit agreement has come about, you owe no payment — our remuneration is success-based only and arises solely once the credit agreement is concluded.
  • Reminder: between one and seven days after the contract is concluded we will remind you by email of this right of withdrawal and of the procedure.
  • Separately — your rights regarding the credit agreement: the lender is bound by its offer for at least 7 days, giving you time to review it (§ 12 HIKrG). You may withdraw from the credit agreement itself within two business days of receiving the ESIS information sheet and the withdrawal information, without giving reasons (§ 13 HIKrG). These rights exist in addition to the right of withdrawal above.

When the brokerage work starts

You may withdraw from the brokerage contract within 14 calendar days (see the withdrawal information). You decide when we start the brokerage work. Nothing is pre-selected — please choose one of the two options.

When should we start the brokerage work?

Option 1 — Immediately: I expressly request and agree that FA – FinanzAktiv e.U. begin the brokerage work before my 14-day withdrawal period has expired.

Option 2 — After my withdrawal period ends: I do not want the brokerage work to start early.

On option 1 — I am aware that

  • processing therefore starts immediately: my details and the documents I upload are prepared and transmitted to the credit institutions eligible for my enquiry before the withdrawal period has expired (scope and recipients: data protection consent);
  • the remuneration remains success-based: it only arises once the credit agreement is concluded (remuneration information) — starting early does not by itself create any claim to payment;
  • this request is not a general waiver of my right of withdrawal: I may still withdraw from the brokerage contract within the period, via the “Withdraw from contract” button or in text form;
  • this declaration is recorded with the time and the text version (evidence of the express request).

Starting immediately does not automatically end my right of withdrawal. It may, however, lapse once the brokerage contract has been fully performed by both parties at my express request (§ 10 Z 3 FernFinG; for contracts concluded from 1 October 2026 § 18b Abs. 5 Z 3 FAGG).

On option 2 — the brokerage work only starts after my withdrawal period has ended. I receive a confirmation stating the start date; until then upload and submission remain blocked. My enquiry is kept and continues at that point in time.

Payment consequence of a withdrawal: none, as long as no credit agreement has come about (see the withdrawal information).
